(k) The department shall establish the amount that the company or organization responsible for community access operations shall receive for such operations from subscribers and from multichannel video programming distributors.
(Proposed draft revision)
(k) The department (PURA) shall establish the fee that the company or organization responsible for community access operations shall receive from multichannel video programming distributors (MVPD's) for every customer account served under their MVPD license.
The existing law must be clarified and reinforced.
Multichannel video programming distributors are required to collect community access support fees from their subscribers. The law should not authorize discrimination of fee collection based upon the mix of services provided to customers. It is still the same wire under the MVPD license. It is: One license, One Wire, and One Customer subscriber account. Suspending line Items from the subscriber fee collection requirements within the mix of the billable items must stop. A simple legislative clarification in the existing language of the law will close this loophole, and save the Institution of Community Access Television.
